The industry of a freelance Virtual Bankruptcy Assistant (VBA) is fairly a new one and you may have questions. We've listed some of the more frequently asked questions about our industry.

Q. What is a Virtual Bankruptcy Assistant? A. A Virtual Bankruptcy Assistant (VBA) is an independent contract who gathers information from clients and drafts the bankruptcy Petition. The Petition is then submitted to the attorney, revised and upon approval is ready to file in the court. A VBA owns their own business and works off-site or most often out of their own home. Like any business owner, a VBA is responsible for paying their own income, state and other applicable taxes. Q. Difference between a bankruptcy Petition preparer and a Virtual Bankruptcy Assistant? A. The difference between a bankruptcy Petition preparer and a virtual bankruptcy assistant is that virtual bankruptcy assistants work solely for attorneys...and not the general public. Q. Is partnering with PAVBS.com fee sharing? A. No. As an independent contractor, my fees are set and are not dependent upon what an attorney will charge their clients or what they receive from their clients to represent them in a bankruptcy proceeding, and will not share in any fees paid by a client to their attorney. If there is work in addition to preparing a Petition, such as client follow-up or case monitoring, I will give a quote based upon the estimated time involved. Q. Do we have to purchase our own bankruptcy software? A.Yes. While a VBA maintains our own office equipment and are computer-savvy, each Attorney must have his own licensed copy of your chosen bankruptcy software. Then, you must provide us with your software license prior to draftng the petition. Q. Can you contact our Clients to do the initial interview? If required, Can you contact them after normal business hours? A. VBAs are generally available 24/7, whether its via email or phone. A VBA is usually available to work with your clients after hour and on weekends. VBAs working with local attorneys may conduct the Client interview at the law firms' office or at the Clients home when its a convenient time for your client. Q. Can you file the Petition directly into court? A. Yes. At your request we can file the completed Petition directly into the case from our bankruptcy software. Your CM/ECF login will be required ...under complete confidentiality, of course. Q. What do you need from us to get started on our Petitions? A. The required documentation is listed within the Service Agreement which can be downloaded at our Attorney Download area (password required). Q. Are you willing to sign our Confidentiality agreement? A. Yes. We are not only willing to sign your specific Confidentiality agreement, we have also included a statement within our Service Agreement. Q. Are you willing to learn skills that we may need? Such as, foreclosure mediation, etc. A. Yes. We love to. In fact we often find it easier to provide the skills that are most beneficial to our Attorney/clients. We are constantly maintaining a level of self education and education provided by leading trainers in the field of bankruptcy law. Q. Can we get a discount if we send you a fair amount of Petitions to draft each month? A. Absolutely! We offer 10% off all monthly invoices when you retain our services to draft a minimum of Ten (10) Petitions per month. You may download our Retainer Agreement from our Attorney Download area. Q. Are you available by phone to discuss any case-related issues? A. Absolutely. Whatever works for you and fit best within your day-to-day workflow.
